Welcome to Holy Boy (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of www.holyboyapparel.store (the “Site”) and any purchases or services made through the Site. By accessing or using the Site, you agree to be bound by these Terms.

1. Use of Our Website

You agree to use the Site only for lawful purposes. You may not use the Site in any manner that violates applicable laws or that could damage, disable, overburden, or impair the Site, our servers, or networks, or interfere with anyone else’s use of the Site.

2. Products & Orders

All products listed are subject to availability. We may change or discontinue products without notice. Prices are listed in USD and may change at any time. We reserve the right to refuse or cancel any order for any reason, including quantity limits, pricing or content errors, or suspected fraud. If we cancel an order after charging you, we will issue a prompt refund of the amount charged.

3. Promotions & Discount Codes

Promotions and discount codes may include expiration dates, usage limits, or exclusions. Only one code may be applied per order unless stated otherwise. Promotions can be modified or canceled at any time. Discounts cannot be applied retroactively to completed orders.

4. Payment

We accept major credit/debit cards and other methods shown at checkout. All transactions are processed securely by our payment providers. You agree to provide current, complete, and accurate billing and payment information and authorize us (and our processors) to charge your selected payment method for your order total, including taxes, shipping, and any applicable duties.

5. Shipping & Delivery

Shipping rates and delivery estimates are shown at checkout. We are not responsible for carrier or customs delays. Once an order is handed to the carrier, risk of loss passes to you. If a package is marked delivered but cannot be located, contact the carrier for assistance and then contact us if you still need help.

6. Returns & Exchanges

We do not offer refunds. We accept exchanges within 14 days of delivery for items that are unused, unwashed, and in original packaging with all tags attached. Customers are responsible for return shipping, and original shipping fees are non-refundable. To start an exchange, email holyboy.sales@gmail.com with your order number and reason for exchange. Final sale items and certain limited releases are not eligible for return or exchange. For damaged, defective, or incorrect items, contact us within 7 days of delivery with photos; once verified, we will arrange a replacement or store credit. EU customers have a 14-day statutory return window; items must be returned in original condition with proof of purchase, and EU return shipping is customer’s responsibility.

7. Intellectual Property

All content, trademarks, logos, images, text, graphics, and product photography on the Site are owned by Holy Boy or our licensors and are protected by law. You may not use, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.

8. User Content

If you tag us, submit a testimonial, review, or share content relating to Holy Boy, you grant us a royalty-free, worldwide, perpetual license to use, reproduce, publish, and display that content for marketing and promotional purposes, subject to applicable law and platform rules. You represent that you own or have rights to any content you submit.

9. SMS & Email Marketing Consent

By enrolling in email and/or SMS, you consent to receive promotions and brand communications. Email opt-out: click “unsubscribe” in any email. SMS opt-out: reply STOP. Message and data rates may apply from your carrier.

10. Optional Tools & Third-Party Links

We may provide access to third-party tools or link to third-party sites. These are provided “as is” and “as available,” without warranties. We are not responsible for third-party content, policies, or actions. Review third-party terms and privacy practices before engaging.

11. Relationship with Shopify

Our store is powered by Shopify. Your purchases are with Holy Boy, not Shopify. You agree that Shopify is not responsible for sales between you and Holy Boy and you release Shopify from claims arising from those transactions.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information. Because our store is hosted by Shopify, certain data processing is performed by Shopify and its service providers. By using the Site, you acknowledge our Privacy Policy and Shopify’s policies.

13. Feedback

If you send us ideas, suggestions, reviews, or other feedback, you grant us a worldwide, perpetual, sublicensable, royalty-free license to use and display that feedback in any medium. You represent that you have the rights to provide it.

14. Errors, Inaccuracies & Omissions

Information on the Site may contain typographical errors or inaccuracies. We may correct or update information and cancel orders affected by errors at any time, including after submission.

15. Prohibited Uses

You may not use the Site for unlawful, harmful, fraudulent, infringing, harassing, or abusive purposes; to upload malware; to scrape or spam; to attempt to circumvent security; or to violate others’ rights. We may suspend or terminate access for violations.

16. Termination

We may terminate or suspend access to the Site at any time. You remain responsible for charges incurred up to termination. Sections that by nature should survive (including IP, Disclaimers, Liability Limits, Indemnification, and Governing Law) survive termination.

17. Disclaimer of Warranties

Except as required by law, the Site and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee continuous, error-free, or secure operation.

18. Limitation of Liability

To the fullest extent permitted by law, Holy Boy and our directors, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Site or products.

19. Indemnification

You agree to indemnify and hold harmless Holy Boy and our affiliates, officers, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or applicable law, or your use of the Site.

20. Severability

If any provision of these Terms is found unenforceable, the remainder will remain in effect, and the unenforceable portion will be limited to the minimum extent necessary.

21. Waiver; Entire Agreement

Our failure to enforce a provision is not a waiver. These Terms, together with posted policies (including Privacy Policy and Returns & Exchanges), are the entire agreement between you and Holy Boy regarding the Site and supersede prior understandings.

22. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without notice.

23. Governing Law & Venue

These Terms are governed by the laws of the State of Missouri without regard to conflict-of-laws principles. Exclusive venue and jurisdiction shall lie in the state or federal courts located in St. Louis, Missouri.

24. Changes to Terms

We may update these Terms by posting a new version on this page. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms. Where required by law, we will provide notice of material changes.
